1.1  This website is solely owned and operated by Spicy Joes

 

2. The contract between us

 

2.1 After placing an order, you will receive email confirmation that we have received your order. Our acceptance of said order brings into being a legally binding contract between us. The contract relates only to the products that you have ordered from us within this specific order.

 

3. Vouchers 

 

3.1 Discounted introductory offers are only available to customers when vouchers have been gifted, or where expressly displayed on our site

3.2 Vouchers only apply to Spicy Joes products, unless expressly stated.

3.3 Vouchers cannot be used in conjunction with any other offers.

3.4 You must have valid payment details to redeem a voucher code.

4. Availability and Delivery

 

4.1 All orders are subject to acceptance and availability’. If we do not have the items you have ordered in stock then we will notify you.

4.2 Spicy Joes currently only deliver orders within the Mainland UK inc Northern Ireland.

4.3 Customer is to ensure that the correct contact and delivery details are on your order. We are not liable to replace or refund any orders that have been delivered to the wrong address.

 

5. Price and Payment

5.1 The prices payable for goods that you order are the prices displayed  on our website. All prices are VAT inc at current rate and are correct at the time of entering information.

5.2 Our product prices can change at any time, but any changes will not affect orders that have already been placed with us at the time of any price change being implemented 

 

6. Risk and ownership

​

6.1 The risk of damage to or loss of the goods passes to the customer only at the time of delivery. The customer will only own the goods once they have been successfully delivered and when we have received cleared payment in full. Spicy Joes products are not to be resold for any reason.

 

7.Refunds Policy

​

7.1 If the customer is unhappy with goods received for any legitimate reason such as: missing items , items damaged or if the order did not arrive, then Spicy Joes we will gladly offer a full / partial refund or replace missing, damaged goods if so desired.

 

8. Cancellation by us

 

We do reserve the right to cancel your order and contract between us if:

8.1.1  for any reason we have insufficient stock of the items that you have ordered.

8.1.2 we cannot effectively deliver to the area that you live in

8.1.4 we consider you in breach of Spicy Joes terms and conditions;

8.2 If we do cancel your order, you will notified by e-mail and Spicy Joes will re-credit any sum deducted from your bank account, Pay Pal Account or credit card as soon as possible.

9. Liability

9.1 If you do not receive goods ordered by you within 10 days of the date from which you placed an order , we will have no liability to you unless you notify us by phone, email or in writing within 30 days said date If you notify a problem to us under this condition, our obligation will be, by your choice :

9.1.1 to resend any shortage or items not delivered

9.1.2 to replace any items that are damaged or defective

9.1.3 to refund to you the amount paid for the items in question

9.2 Both parties will only be liable under this contract for any losses, that are reasonably foreseeable in the event of any relevant breach of contract.

9.4 Nothing contained within our terms and conditions is intended to limit the  rights that you may  have as a consumer under any applicable local law or any statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

 

10. Notices

10.1 Any and all notices from you to Spicy Joes must either be sent via email to : info@spicyjoes.co.uk or in writing to : Spicy Joes, 15 Ash Court, Rugby, Warwickshire. CV22 6EL.

 

11. Changes to legal notices

11.1 Spicy Joes have the right to change any of these terms and conditions, you should look through them as often as possible.

 

12. Law, jurisdiction and language

12.1 This website, any content contained within and any contract brought into being as a result of usage of the website are governed by and construed in accordance with English law. Parties to any such contract agree to submit to the exclusive jurisdiction of the courts of England and Wales. All contracts are concluded in the English language.

 

13. Invalidity

13.1 If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.

 

14. Privacy

14.1 You the customer acknowledge and agree to be bound by the terms of our privacy policy.

 

15. Third party rights

15.1 Nothing in this Agreement is intended to, nor shall it confer any rights on a third party.

 

16. Ownership of rights

16.1 All rights, including copyright of this website are owned by Spicy Joes. Any use of the website or any of its contents is prohibited without our express permission. You may not modify, distribute or repost anything on this website for any purpose.
